Marriage is often referred to by Maine courts as an economic “partnership” It creates legal rights and obligations that give each person a potential claim to the other’s assets, income and business interests at the time the marital bond is dissolved by divorce. A divorce, therefore, can have adverse consequences for the divorcing spouse who owns a business, as well as for that spouse’s partners, fellow shareholders, and even employees. This seminar will discuss various ways in which divorce can affect a business owner and strategies (such as prenuptial agreements, buy-out/buy-back agreements and segregation of pre-marital property) that can be employed to minimize the disruptive and destructive consequences of divorce.
